These Terms govern your use of PA AI’s concierge assistance offered via WhatsApp, email, and our website (the “Service”). “We,” “our,” or “PA AI” refers to the operator of this Service in Punta Cana, Dominican Republic.
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and able to form a binding contract. You represent that all information you provide is accurate.
We facilitate requests such as restaurant reservations, spa/tee times, airport transfers, excursions, and general arrangements. We coordinate options and relay confirmations. We are not a travel agency, carrier, hotel, medical provider, or insurer. We do not provide emergency services or medical advice.
By initiating a conversation or providing your number, you consent to receive service-related messages on WhatsApp, including questions, options, confirmations, reminders, and updates. You can opt out at any time by replying STOP. Standard messaging/data rates may apply. Your use of WhatsApp is also governed by WhatsApp’s own terms and policies.
You are responsible for the accuracy of the details you provide (dates, names, times, headcount, preferences). We will request missing details when needed. We will not place a booking that incurs a charge without your approval. Please review confirmations promptly and tell us immediately if something is incorrect.
Third-party vendors (restaurants, transport, spas, tour operators, etc.) control their own availability, pricing, policies, and safety standards. We do not guarantee availability or pricing and are not responsible for vendor performance, acts, or omissions. We may recommend vendors but final selection is yours.
Unless we explicitly disclose a PA AI service fee in writing before booking, you will pay vendors directly under their terms (including any deposits, taxes, or surcharges). Refunds and cancellations are governed by each vendor’s policy. If we ever charge a PA AI fee, it will be quoted for your approval first and is non-refundable once the service is performed.
We’ll assist with changes or cancellations subject to vendor policies (deadlines, penalties). No-shows or late changes may incur charges. If a vendor cancels or cannot perform, we’ll help find alternatives where possible, but we are not liable for related losses (e.g., missed flights, lost time, consequential damages).
Do not use the Service for illegal activities, dangerous goods, hate or harassment, spam, fraud, or to obtain restricted services. No emergency or medical requests. Do not send payment card numbers or sensitive health information over WhatsApp.
We use your information to deliver the Service (process requests, coordinate with vendors, send confirmations). See our Privacy Policy for details on what we collect, how we use it, retention, and your choices.
All content we create (copy, workflows, brand assets) remains our property or our licensors’. You may not reproduce or use our branding without written permission.
If you share suggestions or content, you grant us a non-exclusive license to use it to operate and improve the Service. You represent you have rights to share anything you submit.
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation, vendor availability, or that every request can be fulfilled.
To the maximum extent permitted by law, PA AI and our personnel shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; or loss of data. Our aggregate liability for claims relating to the Service shall not exceed US$100 or the amount you paid to PA AI for fees in the 3 months before the claim, whichever is greater.
You agree to indemnify and hold PA AI harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your breach of these Terms, or your interactions with vendors.
We are not responsible for delays or failures due to events beyond our reasonable control (e.g., weather, outages, strikes, government actions, pandemics).
We may modify the Service or these Terms at any time. Material changes will be posted on our website with a new effective date. Continued use after changes means you accept the new Terms.
These Terms are governed by the laws of the Dominican Republic, without regard to conflict-of-law rules. Any dispute shall be brought in the courts of La Altagracia Province (Punta Cana/Bávaro), unless applicable consumer law provides otherwise.
